Terms and Conditions — website rental
Version: 2026-10-14. These terms apply to the website rental package only. They do not change the terms of earlier bespoke or owned-website projects.
1. Parties and scope
Burak Kahriman trading as Buka Web Agency ("we") provides a rented, managed business website to you, the customer. The package is: A focused website of up to 3 pages, 3 design directions, one website built from the direction you choose, hosting, HTTPS/SSL, essential maintenance, the defined small-update allowance and the care checks described on the pricing page.
2. What is rented and what is yours
You rent the website build for as long as the rental runs. Buka Web Agency hosts, maintains and keeps it working. Your domain name and the content you supply remain yours. Rental payments do not buy the website build or transfer ownership to you. Third-party licences (fonts, images, plugins) stay subject to their own terms.
3. Price, VAT, start and renewal
£49 per month. £147 is paid upfront for months 1 to 3; from month 4 the monthly amount is payable in advance. No VAT is added to our prices. There is no separate website set-up fee. This covers setting up your website only. Paid email set-up and other add-ons are priced separately. Your first service period starts on the agreed go-live date; monthly billing starts after the prepaid three months. Three calendar months, not 90 days; the exact renewal date is confirmed with your go-live date. If your website goes live on the 29th, 30th or 31st of a month, your first monthly payment is due on the 1st of the month after your first three calendar months end, and each later monthly payment on the 1st. No monthly payment is taken before your first three months end. The day your bank actually pays can move because of bank working days.
4. Brief, materials and design directions
You make the first payment, then complete a short brief; the detailed content, photographs, services and brand files follow. You confirm you have the right to use everything you supply. We prepare 3 design directions and build one website from the direction you choose.
5. Delivery target
three design directions within 3 working days of a complete brief and materials (target, not a guarantee). Launch depends on your content, approvals and any access we need; the whole website is not promised live within 3 days. Essential includes the website editor. Your editor login is handed over together with your website when it goes live. Your website counts as delivered only when its editor is ready and handed over too.
6. Approval, content accuracy and revisions
You choose a design direction and approve the built website in writing (email counts). Go-live then follows on a date we agree: approving the website and going live are separate steps, and your service period starts at go-live. Silence is not approval. You are responsible for the accuracy of the business information you supply.
Revisions before approval. The first round of changes to the design direction you choose is included. Each further round costs £49 and covers up to 60 minutes of work in total. A round is the set of changes you send us together in one list. A new direction, a new page or work beyond 60 minutes is quoted separately. No extra work is started or charged until you have accepted the price and scope. Correcting our own mistakes, or anything that does not match the brief you approved, is never a paid revision. This applies only to revisions of your initial design before you approve it. The monthly small-update allowance stays as it is.
7. Hosting, care and small updates
Hosting, HTTPS/SSL and essential maintenance are included. Small updates: up to 3 requests a month, 30 minutes in total (Essential). Changes you make yourself in the editor do not count towards this allowance. Planned small improvements and customer requests count against the same monthly allowance; unused allowance is not banked. Fixing faults and routine maintenance never use the allowance. Requests are sent by email, kept together in your project record. Support hours: Monday to Friday, 9am to 7pm UK time; weekend replies depend on availability and are not guaranteed. We aim to send a first reply within 2 working days. This is a target for a first reply, not a time to fix or deliver. Working days are Monday to Friday, excluding bank holidays in England and Wales.
8. Additional work
Work outside the package (New pages beyond the agreed scope, New features and online shops, Large content changes, Full SEO campaigns and advertising management, A website you own outright (purchase quote)) is quoted in writing in advance and starts only after you accept the quote.
9. Design satisfaction refund
If you are not happy with the three design directions, ask within 14 days of receiving them and before approving one, and the first payment for your package is refunded in full. The refund covers the first payment in full and ends when you approve a design direction. Covers the package first payment only; extras bought separately (logo and other add-ons) have their own refund terms. This is separate from routine cancellation. Your statutory rights are not affected.
10. Cancellation and end of the rental
To cancel, email us at least 7 days before your next renewal date. That renewal and all later ones then stop, and your website stays live until the end of the period you have already paid for. If you cancel less than 7 days before a renewal, your cancellation takes effect from the renewal after it: the renewal that is due is still payable, and your website stays live until the end of that period. If you cancelled in time and a payment for a later period is still taken (for example because it had already been sent to your bank), you do not owe it and we refund it in full. When the rental ends the website is taken down at the end of the paid period. The build and source files are not transferred automatically. Third-party licences stay subject to their own terms. "Cancel anytime" means you can stop future renewals; it does not mean an immediate refund or a transfer of the build.
11. Domain, email, your content and data
Your domain belongs to you; the domain fee is not included in the package. You register a new domain in your own name and pay for it yourself. We help you choose it and connect it to your website. One webmail mailbox on our hosting is included, with 15 GB of storage; each extra mailbox on our hosting is £5 a month. Optional set-up on Google Workspace or Microsoft 365: We can set up one mailbox on your Google Workspace or Microsoft 365 account after you approve your website. The provider's subscription or licence is paid by you and is not included, and ongoing email support is not included. Setting up that one mailbox is a one-off £20, ordered separately. Every mailbox set-up (the included Plesk mailbox, extra Plesk mailboxes and Google Workspace / Microsoft 365) starts after the customer approves the website; this is a separate event from going live. On request we return the content you supplied; your data is handled as described in the Privacy Policy.
12. Failed payments
If a monthly payment fails, we tell you in writing. If it is still unpaid 14 days after that notice, we may suspend your website temporarily. If it is still unpaid 30 days after the notice, the rental ends. Both periods count from the written notice. No website is suspended or taken down without that written notice.
13. Liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law. If you are a consumer, your statutory rights are not affected.
Subject to that: we are not liable for loss of profits, revenue, business, goodwill or anticipated savings, or for indirect or consequential loss; and our total liability to you arising from the rental in any 12-month period is limited to the rental fees you paid us in that period.
We are not responsible for delays or failures caused by events outside our reasonable control, or by third-party services we do not control (such as your domain registrar or email provider), but we will tell you and do what we reasonably can.
14. Complaints, versions and acceptance
Complaints: [email protected]. These terms are versioned by the date above; the version you accepted is recorded with your order confirmation.
15. Data processing for your website
This section applies when your website collects personal data about other people, for example through a contact form or the server's logs. For that data you are the controller and we act as your processor under Article 28 of the UK GDPR.
- Subject matter and duration: hosting, maintaining and supporting your rented website, for as long as the rental runs and until the data is returned or deleted as set out below.
- Nature and purpose: storing, transmitting and backing up your website and the messages sent through it, and making the changes you ask for, only to provide the rental.
- Types of personal data and people concerned: your website's visitors and the people who contact you through it: technical connection data (such as IP address and browser) and what they type into your website's forms.
- Your instructions: we process this data only on your documented instructions (these terms and what you ask us in writing), including on transfers outside the UK, unless the law requires otherwise. We tell you if we believe an instruction breaks data protection law.
- Confidentiality: everyone we allow to process the data is bound to keep it confidential.
- Security: we take appropriate technical and organisational measures for the data, including encrypted connections (HTTPS), restricted access, updates and backups.
- Sub-processors: you authorise the providers listed in our Privacy Policy as used for customer websites. We tell you before we add or replace one, so you can object; we put the same data protection obligations in a written contract with each, and we remain responsible to you for them.
- Help with your obligations: we help you, as far as we reasonably can, to respond to people exercising their data protection rights, and with security, personal data breaches, data protection impact assessments and consulting the Information Commissioner's Office. We tell you without undue delay after we become aware of a personal data breach affecting your website's data.
- End of the rental: at your choice we return the personal data to you or delete it, and delete existing copies, unless the law requires us to keep them. Backups are overwritten in their normal cycle.
- Information and audits: we give you the information you need to show that these obligations are met, and allow for and contribute to reasonable audits and inspections by you or an auditor you appoint.
